Terms of Service
These Terms of Service ("Terms") are an agreement between you and Instant Scaling ("Instant Scaling," "we," "us," or "our") and govern your use of instantscaling.com (the "Site"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
Please read Section 9 (Disclaimers), Section 10 (Limitation of liability), and Section 12 (Governing law and disputes) carefully. They limit our liability and explain how disputes are resolved.
1. Who may use the Site
The Site is intended for businesses and for individuals who are at least 18 years old. If you use the Site on behalf of a company, you confirm that you are authorized to accept these Terms for that company.
2. What the Site is — and is not
The Site gives general information about Instant Scaling and our marketing services. It is not an offer to provide services and not professional, legal, financial, or tax advice. Contacting us, sending a message, or booking a call does not create a client relationship. We provide services only under a separate written agreement signed by both parties. If that agreement conflicts with these Terms, the agreement controls.
3. Acceptable use
You agree not to:
- Use the Site in a way that breaks any law or regulation
- Send spam, malware, or any unlawful, harmful, misleading, or infringing content through the Site
- Try to gain unauthorized access to the Site, its servers, or connected systems, or interfere with how they work
- Scrape, copy, or collect content or data from the Site with automated tools, except as normal search engines do
- Pretend to be another person or business, or misrepresent your connection with any person or business
4. Information you send us
You confirm that the information you send through the Site is accurate and that you have the right to share it. Unless we have signed a confidentiality agreement with you, please do not send confidential or proprietary information through the contact form. We handle personal information as described in our Privacy Policy.
If you send us ideas, suggestions, or feedback about the Site or our services, you agree that we may use them without any obligation to you.
5. Results and case studies
Case studies, figures, and results on the Site (such as revenue, ad spend, return on ad spend, or growth rates) describe past results for specific clients. They are not typical, and they are not a promise or guarantee of future results. Results depend on many factors, including your offer, product, funnel, pricing, budget, market, and execution. We do not guarantee any particular outcome.
6. Intellectual property
The Site and its content — including text, graphics, logos, design, and layout — are owned by Instant Scaling or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable right to view the Site for your own business evaluation. You may not copy, modify, distribute, sell, or create derivative works from the Site's content without our prior written permission.
"Instant Scaling" and our logo are our trademarks. Other names and brands mentioned on the Site, including client names in case studies, belong to their respective owners. Their mention does not mean they endorse the Site.
7. Third-party links and services
The Site links to third-party websites and services, such as Calendly for scheduling calls. We do not control them and are not responsible for their content, policies, or practices. Your use of a third-party service is governed by that service's own terms and privacy policy.
8. Changes to the Site and suspension of access
We may change, suspend, or stop any part of the Site at any time without notice. We may block or end your access to the Site if we reasonably believe you have broken these Terms.
9. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS COMPLETE, ACCURATE, OR CURRENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INSTANT SCALING AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain disclaimers or limitations of liability. In those jurisdictions, these sections apply only to the extent the law allows.
11. Indemnification
You agree to defend, indemnify, and hold harmless Instant Scaling and its owners, officers, employees, contractors, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) that arise from your misuse of the Site or your violation of these Terms or of any law.
12. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. Before you file a claim, you agree to contact us through the contact form and try to resolve the dispute informally for at least 30 days. If we cannot resolve it, the dispute will be decided exclusively in the state or federal courts located in New Mexico, and you and we consent to the jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date at the top. Changes apply from the date they are posted. If you continue to use the Site after that date, you accept the updated Terms.
14. General
In these Terms, "Instant Scaling," "we," "us," and "our" mean Marmedia LLC, the company that operates the Site. These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, we do not give up our right to enforce it later. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale of our business.
